E. Scott Palmer

Mr. Palmer co-founded the firm and serves as its managing partner.

Mr. Palmer defends consumer lenders and servicers in lawsuits and arbitrations. He also regularly handles real estate, securities and business disputes. He has tried cases to juries, judges and arbitrators.

For consumer lenders and servicers, including banks, mortgage bankers, credit card issuers and auto lenders, Mr. Palmer has extensive experience in the following areas: credit card, checking, travelers check, kiting, wrongful foreclosure, wrongful eviction, wrongful repossession, TILA, RESPA, REO, short sale, forbearance agreement, escrow account, FDCPA, FCRA, loan repurchase, mortgage insurance, force placed insurance, hazard insurance and title insurance litigation.

Notable matters include:

  • Defense of a major charge card issuer in a month long jury trial involving FCRA claims – defense verdict.
  • Defense of a major charge card issuer in a bench trial involving claims re credit reporting, debt collection, etc. – motion for defense judgment granted at close of plaintiff’s case.
  • Defense of a non-profit corporation and its directors in an action by the Kingdom of Norway to reclaim a multi-million dollar parcel of real property in Palos Verdes, CA - after trial, the Court ruled that the corporation owned the real property, and the defendant directors were the rightful directors – not the slate proposed by Norway.
  • Defense of investment firms and individuals in NASD arbitrations – defense awards issued in all matters tried to conclusion.
  • Obtained a multi-million dollar settlement for an investment firm against its insurer arising from earthquake damage to a high rise, ocean front property in Santa Monica.
  • Won numerous summary judgment motions in consumer finance matters, such as FCRA, FDCPA, and “wrongful foreclosure” actions.
  • Defense of class action and 17200 lawsuits.

Mr. Palmer is AV-rated by Martindale-Hubble. In 2005 and 2006, Mr. Palmer was identified by Los Angeles Magazine as a “Rising Star” in the Southern California legal community. He is a member of the Million Dollar Advocates Forum, and a member of the Consumer Financial Services Committee, Business Law Section of the California State Bar.

Mr. Palmer received his bachelor’s degree from the Haas School of Business at the University of California, Berkeley in 1988. He received his juris doctorate degree from the University of Southern California in 1991.
